Privacy Policy for the Processing, Storage, and Protection of Personal Data of Users of the mir-avto.by Website

1. General Provisions

1.1. Sole proprietor Andrey Viktorovich Pudkov (hereinafter referred to as the Operator) ensures the protection of the confidential information of Users of the mir-avto.by website. The Operator will use Users’ personal data only in accordance with this privacy policy (hereinafter referred to as the Policy) and the laws of the Republic of Belarus, in particular, the Law of the Republic of Belarus dated May 7, 2021, No. 99-Z “On the Protection of Personal Data” and the Law of the Republic of Belarus dated November 10, 2008, No. 455-Z “On Information, Informatization, and Information Protection.” This Policy is posted on the website (mir-avto.by), owned by the Operator.

1.2. The Operator’s goal and objective in carrying out its activities is to uphold the rights and freedoms of individuals and citizens when processing their personal data, comply with the law, and the provisions of concluded service and vehicle rental agreements; send notifications, commercial offers, informational, news, and advertising newsletters related to the services provided to the data subject; process inquiries; and maintain accounting and tax records.

1.3. This Operator policy regarding the processing of personal data applies to all information the Operator may receive about visitors to the mir-avto.by website.

1.4. The Operator reserves the right to make changes to this Policy without prior notice. The current version of the Policy is posted on the Operator’s website mir-avto.by. In the event of disputes, the Policy posted on the mir-avto.by website shall apply.

2. Key Terms Used in the Policy

2.1. Website — a collection of graphic and informational materials, as well as computer programs and databases, making them available online at the address mir-avto.by;

2.2. User — any visitor to the mir-avto.by website;

2.3. Personal Data Subject — the individual in relation to whom the personal data is processed.

2.4. Operator — a government agency, a legal entity of the Republic of Belarus, another organization, or an individual, including an individual entrepreneur (hereinafter, unless otherwise specified, an individual), independently or jointly with other specified persons, organizing and/or carrying out the processing of personal data.

2.5. Personal Data — any information relating to an identified or identifiable individual.

2.6. Provision of personal data refers to actions aimed at familiarizing a specific individual or group of individuals with the personal data.

2.7. Anonymization of personal data refers to actions that make it impossible to determine the attribution of personal data to a specific data subject without the use of additional information.

2.8. Processing of personal data refers to any action or set of actions performed with personal data, including collection, systematization, storage, modification, use, anonymization, blocking, distribution, provision, and deletion of personal data.

2.9. Publicly available personal data refers to personal data disseminated by the personal data subject themselves or with their consent, or disseminated in accordance with legislative requirements.

2.10. Provision of personal data refers to actions aimed at familiarizing a specific individual or group of individuals with the personal data.

2.11. Dissemination of personal data refers to actions aimed at making personal data available to an indefinite number of people.

2.12. Information refers to information about individuals, objects, facts, events, phenomena, and processes, regardless of the form in which it is presented.

2.13. Information security refers to a set of legal, organizational, and technical measures aimed at ensuring the confidentiality, integrity, authenticity, availability, and security of information.

2.14. Information network refers to a set of information systems or software and hardware systems of an information system interacting via telecommunication networks.

2.15. Personal data information system refers to a set of databases, information technologies, and software and hardware systems (systems) contained in personal data databases that facilitate their processing.

2.16. Confidentiality of information is the requirement to prevent the dissemination and/or provision of information without the consent of its owner or other grounds stipulated by the laws of the Republic of Belarus.

2.17. Blocking of personal data is the termination of access to personal data without its deletion.

3. User’s personal data that may be collected and processed by the Operator. User categories, list of personal data processed

3.1. The Operator may receive, process, and store the following User’s personal data:

  • Last name, first name, and patronymic (if any);
  • Full or partial registered or residential address, and location;
  • Order history;
  • Phone number, including linked accounts in Viber, WhatsApp, Telegram, and other messaging apps, provided when placing an order on the website or provided to the Operator in accordance with the agreement;
  • Email address;
  • Identification number, identity document details;
  • Driver’s license details;
  • The website collects and processes anonymized visitor data (including cookies) using internet statistics services (Yandex Metrica, Google Analytics, and others).

3.2. Categories of Users whose data is processed:

  • Users of the Operator’s website;
  • Contract customers.

4. Information that may be collected and processed by the Operator

4.1. The Website pages may include embedded content (e.g., videos, images, articles, etc.). Such content behaves as if the Visitor has visited another website. These websites may collect data about the User, use cookies, implement additional third-party tracking, and monitor interactions with the embedded content, including tracking interactions as if the User already has an account and is logged in to that website. The Operator uses cookies to remember the User’s preferences and to collect and process analytical data about Website visits and other data using internet statistics services and third-party services. The third parties and internet statistics services mentioned above include the following organizations, companies, and services: the website server provider, visitor counters provided by Yandex and Google, the Yandex.Metrica statistics service, Google AdSense and Google Adwords advertising services, the SendPulse email service, the Bitrix24 chat service, Facebook.com, VKontakte, Twitter, Odnoklassniki, Yandex Market, Marquiz.ru, YouTube, Vimeo, and others.

4.2. The Operator collects and stores technical and other information:
– The user’s IP address, location, and browser type;
– The user’s encrypted login and password;
– Information about products and services viewed, and pages visited on the Website;

– other data specified in agreements, questionnaires, and forms completed by the User on the mir-avto.by website or communicated to the Operator by the User of the website by phone, email, or otherwise.

4.3. The User’s consent, including to the use of cookies in accordance with the Cookie Policy (posted on the mir-avto.by website), constitutes consent to the processing of the User’s data.
By providing their personal data, the User agrees to its processing (until the User revokes their consent to the processing of their personal data) by the Operator for the purpose of providing the User with services, advertising, reference and technical information, and for other purposes in accordance with Section 5 of this Policy.

4.4. The User agrees to this Policy by providing the Operator with the following information: last name, first name, email address, contact phone number (including Viber, WhatsApp, Telegram, etc.), and rental start and end dates. The User then submits a request to order a car, leave a review, subscribe to the newsletter, receive notifications, and receive replies to pop-up messages. By clicking the “Order a Car,” “Order,” “Send,” “Request a Call,” “Send Message,” or “Feedback Form” buttons, the User agrees to this Policy. By completing these actions, the User sends their personal data to the Operator’s email address for the purposes of further communication and sending promotional and informational emails.
The Operator processes the User’s personal data only if the User completes and/or submits it independently through the designated forms located on the website. By completing the relevant forms and/or submitting their personal data to the Operator, the User consents to this Policy.

5. Purposes of Collection and Processing of Personal Data

5.1. The purpose of processing the User’s personal data is to ensure secure access to the services, information, and/or materials contained on the mir-avto.by website.

5.2. The Operator collects, processes, and stores the personal data of website users, as well as the personal data of other data subjects received from counterparties, for the following purposes:

  • further communication regarding the User’s requests;
  • sending advertising, informational, and reference messages;
  • for promotional activities;
  • evaluating and analyzing the Website’s performance;
  • analyzing the effectiveness of advertising placements;
  • informing the User about promotions, discounts, and special offers from advertisers via email and messaging;
  • fulfilling an agreement or contract to which the personal data subject is a party, beneficiary, or guarantor.

5.3. The Operator reserves the right to send notifications to the User, including push notifications, email and SMS messages, instant messaging, etc., if the User has consented to this for the purposes of further communication and the sending of promotional, informational, and other mailings. The User can always unsubscribe from receiving informational messages by sending an email to the Operator at mir-avto14@tut.by with the subject line “Unsubscribe from notifications about new products, services, and special offers.”

5.4. Anonymized User data collected through internet statistics services is used to collect information about User activity on the website and to improve the quality of the website and its content.

5.5. The Operator processes and stores the User’s personal data only if it is completed and/or submitted by the User independently through special forms located on the mir-avto.by website, or when placing an order by phone or via instant messaging. By completing the relevant forms and/or submitting their personal data to the Operator, the User consents to this Policy.

5.6. The Operator processes anonymized data about the User if this is permitted in the User’s browser settings (saving cookies and using JavaScript technology are enabled).

6. Personal Data Processing Procedure

6.1. The Operator collects, processes, and ensures the security of personal data, and takes all possible measures to prevent unauthorized persons from accessing such personal data.

6.2. The security of personal data processed by the Operator is ensured by implementing legal, organizational, and technical measures necessary to fully comply with the requirements of current legislation on personal data protection.

6.3. The User’s personal data will not be transferred to third parties, except in cases related to compliance with current legislation. If the User’s personal data needs to be provided to third parties (including authorized government agencies) to achieve the stated purposes, fulfill a contract, or engage third parties to perform work (provide services), or if the Operator transfers its functions and powers to another party, the Operator has the right to transfer the User’s personal data to such third parties to the required extent without obtaining the User’s additional consent. The User has the right to obtain information from the Operator regarding the provision of their personal data processed by the Operator to third parties.

6.4. If any inaccuracies are discovered in their personal data, the User may update it independently by sending a notification to the Operator’s email address mir-avto14@tut.by with the subject line “Updating personal data.”

6.5. The processing and storage period for personal data is unlimited. The User may revoke their consent to the processing of personal data at any time by sending a notification to the Operator via email to mir-avto14@tut.by with the subject line “Revocation of consent to the processing of personal data.”

6.6 The right to revoke consent to the processing of personal data cannot be exercised by the User if the processing is carried out on the basis of a contract or in accordance with legal requirements.

7. User Rights

7.1 The User has the right to revoke their consent at any time without explanation by submitting a request to the Operator in the manner prescribed in Section 6.5 of the Policy or in the form by which their consent was obtained.

The Operator is obligated, within fifteen days of receiving the User’s request, to cease processing personal data in accordance with its content, delete it, and notify the data subject thereof, unless there are other grounds for such actions with personal data stipulated by law. If deletion of personal data is not technically feasible, the Operator is obligated to take measures to prevent further processing of the personal data, including blocking it, and notify the data subject thereof within the same period.

7.2. The User has the right to receive information regarding the processing of their personal data, including: the name (last name, first name, patronymic (if any)) and location (place of residence (place of stay)) of the Operator; confirmation of the processing of personal data by the Operator (authorized person); their personal data and the source thereof; legal grounds and purposes for processing personal data; the period for which their consent is given, etc. To receive information, the User shall submit an application to the Operator by email to the Operator’s email address mir-avto14@tut.by with the subject “Obtaining information about the processing of personal data.”

The Operator is obliged, within five business days of receiving the User’s application, to provide them with information in an accessible form or notify them of the reasons for refusing to provide it. Such information shall be provided to the personal data subject free of charge, except in cases stipulated by law.

7.3. The User has the right to request that the Operator amend their personal data if such data is incomplete, outdated, or inaccurate. For these purposes, the User shall submit an application to the Operator in the manner prescribed by Section 6.4 of the Policy, along with the relevant documents and/or their duly certified copies confirming the need to amend the personal data.

7.4. The User has the right to receive information from the Operator regarding the provision of their personal data to third parties once per calendar year free of charge, unless otherwise provided by law and other legislative acts. To receive this information, the User shall submit an application to the Operator by email to mir-avto14@tut.by with the subject line “Receiving information about the provision of personal data to third parties.”

7.5. The User has the right to request that the Operator cease processing their personal data free of charge, including deletion, if there are no grounds for processing the personal data stipulated by law. To exercise this right, the User must submit a request to the Operator by email to mir-avto14@tut.by with the subject line “Request to cease processing personal data.”

The Operator has the right to refuse the personal data subject’s request to cease processing their personal data and/or delete it if there are grounds for processing the personal data stipulated by law, including if the personal data is necessary for the stated purposes of processing, with fifteen days’ notice to the personal data subject.

7.6. The User has the right to appeal the Operator’s actions (inactions) and decisions that violate their rights when processing personal data to the authorized body for the protection of the rights of personal data subjects in the manner prescribed by law on appeals from citizens and legal entities. The decision taken by the authorized body for the protection of the rights of personal data subjects may be appealed by the personal data subject in court in the manner prescribed by law.

8. Final Provisions

8.1. The User may obtain any clarifications regarding the Policy regarding the processing of their personal data by contacting the Operator by email at mir-avto14@tut.by.

8.2. This Policy is valid indefinitely until replaced by a new version.

8.3. The current version of the Policy is publicly available online at https://mir-avto.by/politika-konfidenczialnosti/.

8.4. In the event of failure to fulfill its obligations to protect personal data, the Data Operator is liable for damages incurred by the User due to the unauthorized use of personal data, in accordance with the legislation of the Republic of Belarus, with the exception of cases specified below and provided for in the legislation of the Republic of Belarus.

8.5. The Data Operator shall not be liable if confidential information regarding personal data:

– became publicly known prior to its loss or disclosure;
– was received from a third party prior to its receipt by the Data Operator from the User;
– was disclosed with the User’s consent.

8.6. In the event of any disputes related to the protection of personal data, its disclosure, etc., the Data Operator and the User will seek to resolve them through negotiations. If reaching a consensus is not possible, the dispute will be referred for resolution in accordance with the established procedure.

8.7. When processing personal data, the Data Operator takes necessary and sufficient organizational and technical measures to protect personal data from unauthorized access, as well as from other illegal actions in relation to personal data.
